Terms of Service

These Terms of Service ("Terms") govern your access to and use of Vtoba mobile apps, websites, and related services (the "Services") provided by Vtoba Software Private Limited ("Vtoba", "we", "us"). By creating an account or using the Services, you agree to these Terms, our Privacy Policy, and our Community Guidelines.

1. Eligibility

You must be capable of forming a binding contract under Indian law to use the Services. If you are under 18, you may use the Services only with consent of a parent or lawful guardian where required (including for digital personal data processing under applicable law). If you use the Services on behalf of an organization, you represent that you have authority to bind that organization.

2. Account registration

• Provide accurate information and keep it updated
• Keep credentials confidential and notify us of unauthorized use
• You are responsible for activity under your account
• One person or entity should not maintain multiple abusive accounts

3. The Services

Vtoba offers location-based social features including profiles, rankings, brand and place discovery, reviews, civic issue reporting, feeds, and related tools. Features may change, and we may add, modify, or discontinue functionality with or without notice.

4. User content

You retain ownership of content you submit (posts, photos, reviews, issue reports, etc.). By submitting content, you grant Vtoba a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify (for formatting), display, and distribute that content as needed to operate and promote the Services.

You represent that you have rights to the content you submit and that it does not violate law or third-party rights. You agree to follow our Community Guidelines.

5. Acceptable use

You agree not to:

• Harass, threaten, defame, or discriminate against others
• Post illegal, pornographic, or exploitative content
• Manipulate rankings, reviews, or civic reports through fraud or bots
• Scrape, reverse engineer, or disrupt the Services
• Impersonate others or misrepresent affiliation
• Upload malware or attempt unauthorized access
• Use the Services for spam or unlawful advertising

6. Rankings, scores, and discovery

Rankings and scores are generated using proprietary signals and community activity. They are informational, may change, and do not constitute professional, financial, or legal advice. We may adjust algorithms to improve fairness, safety, and quality.

7. Civic issues

Civic reports are user-generated. Vtoba does not guarantee governmental action or resolution. Do not post false reports, private personal data of others without authority, or content that endangers safety.

8. Brands and business pages

Brand pages may include user and public information. Claiming or managing a brand requires authorization. Misrepresentation of ownership may result in removal and account action.

9. Intellectual property

The Services, Vtoba name, logos, and software are owned by Vtoba Software Private Limited or licensors. Except for the limited rights granted to use the Services, no IP rights are transferred to you.

10. App stores

Downloads via Google Play or Apple App Store are also subject to the respective store terms. Store operators are not parties to these Terms between you and Vtoba, except where required by store rules.

11. Intermediary / platform role

To the extent Vtoba hosts user-generated content, we act as an intermediary under applicable Indian law (including the Information Technology Act, 2000 and relevant intermediary guidelines, as applicable). We may remove or restrict content that violates these Terms, applicable law, or rights of others, and may respond to lawful orders and notices.

12. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Vtoba Software Private Limited AND ITS DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SERVICES SHALL NOT EXCEED THE GREATER OF INR 5,000 OR THE AMOUNTS YOU PAID US (IF ANY) IN THE TWELVE MONTHS BEFORE THE CLAIM.

14. Indemnity

You agree to indemnify and hold harmless Vtoba Software Private Limited from claims arising out of your content, your use of the Services, or your violation of these Terms or applicable law.

15. Suspension, deactivation, and deletion

We may suspend or terminate access for violations, risk, or prolonged inactivity. You may stop using the Services at any time. You may deactivate your account in the app Settings, and request permanent deletion as described at Delete your account.

16. Governing law and disputes

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Courts in Hyderabad, Telangana, India shall have exclusive jurisdiction, subject to any mandatory consumer protections that apply to you.

17. Changes

We may update these Terms. Continued use after changes become effective constitutes acceptance. If you do not agree, discontinue use of the Services.
